Article 1 : Scope

These general conditions of sale (below referred to as the "General Conditions") govern the contractual relationship between any user of the site zeinberg.com (below referred to as "user" or "you") and the company YKF whose registered office is 84 rue Beaubourg - 75003 Paris (below referred to as "Zeinberg").

These general conditions of sale are the only ones applicable and replace all the other conditions, unless a derogation has been granted expressly and by writing. Zeinberg may occasionally be required to modify certain provisions of its general conditions. It is therefore necessary that they be re-read at each visit to the site zeinberg.com (below referred to as "the site"). These modifications are effective from the time they are posted (the online date appearing at the end of these conditions) and can not be applied to contracts previously concluded.

Each purchase made on the site is governed by the terms and conditions applicable on the date of the order. Validation of your order implies acceptance of the general conditions.

Zeinberg provides services, products and deliveries exclusively on the basis of these general conditions of sale.

Zeinberg does not recognize any conflicting conditions of the customer, unless Zeinberg has expressly acknowledged their validation in writing.

Article 2 : Use of the website

The use of the site is conditioned by the acceptance of the general conditions of sale and, if necessary, by the respect of the applicable conditions of use. You warrant the truthfulness and accuracy of the information provided by you on the site.

The user undertakes not to upload on the site any content likely to infringe the law in force, in particular criminal law, copyright, trademark law and other property rights or rights of third parties.

The site is available in French and English. The language of the site is determined according to the language settings of your browser. If your browser language is other than English or French, the language of the site will be English. However, you can change the language at any time on the homepage of the site.

Zeinberg strives to ensure the accuracy of the information presented on the site as well as their updating. The company also reserves the right to rectify their contents at any time and without notice. However, Zeinberg can not guarantee the accuracy, precision and completeness of the information provided on the site. Product features

Zeinberg produces framed prints and prints as well as professional grade laminated prints with optional framing and / or laminating from your photographs. Our specialized photographic laboratory also offers high quality Acrylic Glass laminated prints and carefully manufactured shadowgap-frames.

Several formats are proposed according to the user's photograph format.

Steps of the order

To place an order, you must go through the following steps:

  • 2. "Personalization" screen: on this screen, you have the possibility to choose the customization criteria for your print
  • 3. "Cart" screen: after your confirmation, the order is added to your cart

 

The validation of your basket is equivalent to accepting these general conditions of sale. The general conditions can be consulted at any time on the site.

Once the order is made, Zeinberg sends you a confirmation email. In certain circumstances, Zeinberg can reject a customer’s orders. Zeinberg may in particular use this right when the payment relating to a previous order has not been made and the solvency of a customer is not insured.

The contract is concluded when the written confirmation of the order is sent by Zeinberg, or when Zeinberg begins its execution. The amount of the order is due immediately. The user is in this respect subject to an obligation of care.

Payment methods

Several payment methods are available to pay your order on the site:

  • Carte bleue, Visa, Mastercard
  • Paypal
  • Gift Card: A gift card can be used to pay for multiple orders. Gift cards are not exchangeable, extendable or refundable and they are valid for one year (except the Gift Cards sold on Vente Privée - valid until the given date during the purchase).

 

The remuneration for our services is the one indicated in the price list currently online and which we specify as part of the order procedure. We reserve the right at any time to change the price list for future orders without notice.

Payment security

Whatever the method of payment chosen by the user, the transaction is made via Paypal.

In order to guarantee the security of online payments and the protection of your personal data, transaction data is encrypted using SSL (Secure Socket Layer) technology, which secure their transmission. They are in no way communicated to Zeinberg and do not circulate in clear on the internet. They can not be intercepted.

Evidence

The data recorded by the site constitutes proof of all transactions between Zeinberg and its customers.

The data recorded by the paypal payment system is proof of financial transactions.

Delivery address

Zeinberg delivers in mainland France, Germany, Belgium, Great Britain, Spain, the Netherlands, Luxembourg, Denmark, Sweden, Portugal, Poland, Greece, the Czech Republic, Slovakia, Norway, the United States, Canada, Switzerland, Mexico, Singapore, Hong Kong, Australia, China, Indonesia, Japan, South Korea, Thailand, Israel and Lebanon.

Shipping is made to the delivery address you indicate at the time of order. It is possible to indicate a different billing address than the delivery address.

For logistical reasons, the change of delivery address is no longer possible once the order has been placed.

You will receive your order at the address you have indicated within 30 working days after placing your order.

The delivery times announced are not contractual. Consequential damages can not be compensated. Zeinberg reserves the right to make partial deliveries when this is necessary. In this case, the shipping costs are not increased. All work ordered is usually shipped in one delivery.

Please note that the delivery takes place at the bottom of the building.

Shipping costs

Shipping costs will be collected by Zeinberg for orders made with the delivery method "Home Delivery". These fees are indicated on the Zeinberg website.

The delivery is free for orders made with the delivery method "Click & Collect" - for a delivery in a YellowKorner gallery where this service is activated.

For orders with a gallery delivery, customers have a maximum of 4 months after receiving notification of their order to come to collect it. Failing this, the order will be cancelled and the amounts paid will be retained by the supplier in compensation. Beyond this period, the customer cannot claim a refund or delivery of the article(s).

In case of shipment to countries outside the European Union, and in the case taxes, duties or customs were due, those will be entirely at the charge of the customer.

Reception of the order

In the event of a claim, all the vouchers relating to the order must be communicated to us within a maximum of 10 working days. For the calculation of this delay, the delivery date as well as the day of receipt of the claim will be taken into account. If these parts are not available to us, the examination and immediate processing of the claim will not be guaranteed.

If you are a merchant, you must check the status of the products immediately after their delivery and, if necessary, send us your complaint in writing without delay; the French commercial code applies without limitation.

Reserve of property

Zeinberg has the full property of sold products until the order payment is made in integrality.

Right to retract

Under Section 312D Section 4 N1 BGB (Right of Revocation and Restitution for Distance Selling Contracts), please note that any right of withdrawal and revocation is excluded because the work performed by the Zeinberg Laboratory is only based on dimensions, finishes, improvements and arrangements of details that are freely chosen by the customer; these works are indeed made in a personalized way and adapted to the personal needs of the customer.

Article 3 : Liability

With the exception of attacks on life, physical integrity and health and non-compliance with fundamental contractual obligations (cardinal obligations), Zeinberg's liability is only incurred for damages resulting from gross negligence or willful misconduct.

Liability is assumed towards consumers as defined by the French Civil Code, and is limited to foreseeable and typical damage at the time of the conclusion of the contract.

If the fundamental contractual commitments (cardinal obligations) are not respected, our liability for minor negligence is limited to foreseeable and typical damages for this type of contract.

The responsibility is assumed towards the contractors in the sense defined by the French civil code, and is limited to the foreseeable and typical damages for this kind of contracts, except in case of injury to the life, to the physical integrity and the health, or damage resulting from gross negligence or willful misconduct by Zeinberg.

The limitation of liability mentioned in the preceding paragraphs also applies to Zeinberg employees and vicarious agents.

Liability as defined by the Product Liability Act remains unaffected.

Article 4 : Protection of personal data

The personal information that you entrust to Zeinberg is stored on the secure servers of our Open Resources host (excluding banking data); access to this information is protected and limited to the registration and processing of your orders, statistical operations allowing us to improve our services and services such as sending newsletters.

We use the personal data you give us (title, surname and first name, postal address, e-mail address and phone number, as well as payment information) in accordance with the provisions of the French law on data protection, and only for the processing and execution of your order, and sending notifications by e-mail - to inform you about the status of your orders, for example. we also record the terms of the contract and send you order information by e-mail.

No further transmission of your data will be made unless required by law or regulation. The same principle applies to personal data that you have given us during a contact (electronically or in a form).

In order to guarantee absolute security, we only communicate the payment details (such as your bank details or your credit card details) to our payment service provider, and we do not store them ourselves. this data will be requested again with each order.

The data relating to the images that you have uploaded to the site are in no way used by Zeinberg for advertising purposes or for any other purpose without your explicit permission. In addition, Zeinberg undertakes not to transmit your photographs to third parties, and to destroy the files within 12 months after placing the order.

In accordance with French data protection legislation, you also have the right to free access to the data stored about you, as well as the right to rectify, block or delete such data. All you need to do is contact our customer service directly at contact@zeinberg.com.

Article 5 : Intellectual property

The user certifies to hold all necessary intellectual property rights associated with the images being ordered on the site.

As such, Zeinberg can not be held responsible in case of copy, infringement, imitation, and more generally in case of reproduction or partial or full use of images used by the user.

No photographs of a homophobic, pedo-pornographic, xenophobic or racist nature may be printed by Zeinberg.

Article 6 : Applicable law / Competent jurisdiction

The implementation of the contract and the interpretation of these general conditions of sale are subject to the law of the French Republic, excluding the United Nations Convention on Contracts for the International Sale of Goods.

Zeinberg undertakes to respect all the legal warranties that you may have. The products and services we offer comply with French law. We can not be held responsible for any transgressions of laws specific to other countries.

If the user is a merchant within the meaning of the French Commercial Code, a legal person or a company governed by public law, if it does not fall within the jurisdiction of an ordinary court in the country, or if its usual place of residence is not known at the time of the summons, the only court competent for all disputes arising from the contractual relationship or in relation with it, as well as the place of performance for payment, delivery and performance are the headquarters of Zeinberg, in Paris.
